recently passed Texas Senate Bill 2128 adds much needed clarity to recording
requirements for electronically executed (eSigned) documents. The bill,
which takes effect September 1st, amends the Texas Local
Government Code to specifically allow for eSigned documents to be recorded in
counties that do not currently allow electronic recording. To qualify, an
eSigned document must be printed out and certified by a notary prior to
recordation. This represents an important step forward for the adoption
of eMortgages, as eSigned documents will now be eligible for recordation in all
of Texas’ 254 counties. The full text of the bill may be found here.
